Terms and conditions

The terms and conditions listed on this page apply to purchases made in the online store www.viagem.cz from September 30, 2024.

The public terms and conditions (hereinafter referred to as “Terms”) define and specify the rights and obligations of the operator and the customer or advertiser when using the website (hereinafter referred to as “Server”) operated by the operator, or when concluding purchase agreements with the following companies:

A customer or advertiser refers to a natural or legal person whose actions aim to conclude a legal transaction with the Seller or who uses the Company's pages for other purposes (hereinafter referred to as “Client”).

All contractual relationships between the buyer and the Seller are concluded in accordance with the legal order of the Czech Republic. If the contractual party is a consumer, relationships not regulated by the terms and conditions are governed by the Civil Code (No. 89/2012 Coll.) and the Consumer Protection Act (No. 634/1992 Coll.). If the contractual party is not a consumer, relationships not regulated by the terms and conditions are governed by the Civil Code.

The Company offers the following services on the Server, which the Client can order or secure (hereinafter referred to as “Services”):

If a contract or another legal relationship anticipated by these Terms arises between the Client and the Company or a person from the Company's group based on an order for services under the Terms, this contract is also governed by these Terms.

Advertising on the Server is provided to Clients free of charge.

Advertising is available on the Server to all natural and legal persons (hereinafter referred to as “Advertiser”) who register into their user account, through which they publish an offer of real estate (hereinafter referred to as “Advertisement”) on the Server.

All data is entered by the Advertiser on the Server at their own expense and in accordance with the guidelines provided by the Company on the Server.

Within the capabilities provided by the Server, the Advertiser is entitled to edit their Advertisement and its content through their user account. The Advertiser is obliged to promptly update their Advertisements if there are changes in the status of the data provided.

The Advertiser agrees to publish only truthful and unaltered data on the Server that is not misleading or otherwise harmful (including direct contact details, e.g., phone number, email, etc.) and does not violate the rights of third parties. In the case of a breach of this provision, the Company is entitled, depending on the severity of the breach, to request the Advertiser to remedy the situation and to suspend or terminate the publication of the Advertisement on the Server.

The Advertiser acknowledges that the data about properties published on the Server is accessible to Internet users through the Server and other Internet servers. The Advertiser agrees that the data about the properties they advertise may also be published in promotional materials and other advertising messages of the Company or persons from the Company's group.

The Advertiser is entitled to delete or deactivate their Advertisement at any time through their account or request the cancellation of their Advertisement in writing via the Company's email address.

The Company reserves the right to delete the Advertiser's Advertisement even if they do not request it, if:

The Client has the right to create a free user account on the Server for the purpose of using the Services.

The Client registers a free user account by filling in their email address, password, and other required information on the Server, which is then saved. To create an account, the Client must consent to these terms and conditions and familiarize themselves with the information regarding Personal Data Processing.

The contact details filled in by the Client during registration will be published on the Server only with the Client's consent.

The Client is not authorized to disclose their access credentials to third parties. If the Client allows a third party access, even through negligence, they bear responsibility for any misuse of the user account and their data, as if it were their own actions, and they also bear the risk of contractual penalties imposed by the Company.

The Client acknowledges that their user account may not be available continuously, particularly due to necessary maintenance of the Company's hardware and software, or the maintenance of third-party hardware and software.

The Client agrees not to publish any data that is in conflict with the legal order of the Czech Republic. Furthermore, the Client agrees that they will not hold the Company liable for any legal claims from third parties arising from the publication of data provided by the Client via the Server.

If there are changes to the Client's data, the Client is obliged to promptly update it in their user account.

The Company reserves the right to refuse to publish data entered by Clients on the Server or to remove this data if it meets one or more of the following conditions:

The Client is entitled to request the cancellation of their free user account at any time, in writing to the Company's email address.

The Company is entitled to cancel a user profile, particularly if the Client has not used their account for more than 2 years. Furthermore, the Company is entitled to cancel a user profile for violating these Terms.

The Server includes the option to purchase real estate directly from the Company. All offers published on the Server are non-binding, and the Company is not obligated to conclude the relevant contract. The Client acknowledges that confirming the purchase through the Server does not create any claims to the properties or against the Company or other Advertisers.

The Company only realizes the transfer of real estate based on a written purchase agreement. All rights and obligations arising for both the Company and the Client are conditioned upon the conclusion of a written purchase agreement.

The advertising displayed on the Server is for informational purposes only and is not an offer in the sense of § 1731 and § 1732 of the Civil Code (No. 89/2012 Coll.) nor is it a public promise according to § 1733 of the Civil Code.

For the purchase of real estate, the Client may choose one of the following four mediation options:

All four mediation options are available on the Server free of charge and do not bind the Company or the Client to complete the purchase of the real estate. The selection of a mediation option is non-binding and may subsequently be changed with the consent of both parties.

The Company reserves the right to delete the Client's account if they repeatedly confirm the purchase of real estate through the Server that is not subsequently realized.

Submitting a purchase confirmation is conditional upon agreeing to the Terms and consenting to Personal Data Processing.

If any provision of the Terms is invalid or ineffective, this fact does not cause the invalidity or ineffectiveness of the other parts of the Terms.

If a dispute arises regarding the legal relationship between any person using the Services and the Company, the Client who is a consumer has the right to a non-judicial resolution. The consumer Client is entitled to submit a proposal for non-judicial resolution according to the Consumer Protection Act to the Czech Trade Inspection Authority. All details regarding non-judicial resolution are provided on the website www.coi.cz.

The Company reserves the right to change these Terms even without the prior consent of the Client by publishing the latest and complete wording on its website. Such publication will enter into effect, unless a later date is specified in the terms and conditions. A notice regarding the change of Terms will be published on the Company's website.

Relations and any disputes arising from the performance under these conditions will be resolved exclusively according to the laws of the Czech Republic and by the competent courts of the Czech Republic.

These Terms come into effect on September 30, 2024.
